Attorney Ames has litigated extensively in the federal and state courts, including the Court of Appeal. Here are just a few of the Decisions of the Courts in his cases:

 

Retaliation/ Wrongful Termination/ Sexual Harassment:


“De Jardin v. Kindred Healthcare Operating, Inc.”– the California Court of Appeal reverses the Orange County Superior Court’s summary judgment to the Defendant hospital, ruling in favor of Attorney Ames’s client, Plaintiff De Jardin. Read the Court of Appeal’s decision Here.

 

Whistleblower Retaliation:


“Courey v. Kindred Healthcare Operating, Inc.”– In a case involving whistleblower retaliation by a hospital for firing a nurse after reporting a co-worker’s drug use, the California Court of Appeal reverses the Orange County Superior Court’s summary judgment to the Defendant hospital,again ruling in favor of Attorney Ames’s client, Plaintiff Courey. Disability Discrimination/ Failure to Provide Reasonable Accommodations/ Constructive Termination:


“Brooks v. Allstate Insurance Company”— In this decision from the U.S. District Court, Ames represented Ray Brooks, a longtime manager for Allstate that had developed multiple sclerosis. After the Court rejected Allstate’s motion for summary judgment, this case settled in a non-confidential settlement for $1.6 million in favor of Brooks. Public Entity Wrongful Termination/ Constitutional Deprivation of Due Process:

“Sato v. Orange County Department of Education”–

Attorney Ames represents a former public employee who alleges he was wrongfully terminated, giving rise to constitutional claims of violation of due process. While the U.S. District Court in this case declined to overrule a long-standing Ninth Circuit precedence, new state law may reverse this decades old rule. The case is currently on appeal by Attorney Ames before the U.S. Court of Appeals for the Ninth Circuit. Read the U.S. District Court’s decision Here.
